Contract Labour (Regulation and Abolition) Act: Compliance for Businesses
Any business engaging 20 or more contract workers (through a contractor, not directly employed) must register as a Principal Employer under the Contract Labour (Regulation and Abolition) Act, and the contractor supplying those workers must separately hold a labour license. Both registrations are mandatory before contract labour is engaged.
Principal Employer's obligations
- Register as Principal Employer with the appropriate labour authority before engaging contract labour
- Ensure the contractor holds a valid labour license
- Maintain a register of contractors engaged
- Ensure wages are paid to contract workers in the Principal Employer's presence or that of an authorised representative
- Step in to pay wages directly if the contractor defaults (then recover from the contractor)
Contractor's obligations
- Obtain a labour license specific to each establishment/Principal Employer
- Provide welfare facilities — canteen (if 100+ workers), rest rooms, first-aid, drinking water, latrines/urinals
- Pay wages on time and maintain wage registers
- Provide identity cards to contract workers
Equal pay and "sham contracting" risk
If contract workers perform the same work as regular/permanent employees under similar conditions, they may be entitled to the same wages — and courts have, in several cases, treated contract arrangements as a sham where the contractor had no real independent control, effectively making the Principal Employer the actual employer with full liability.
Why this matters for growing businesses
Many businesses scale using staffing agencies or labour contractors without realising the Principal Employer registration requirement — this is a frequently overlooked compliance gap that surfaces during labour inspections or disputes.
Penalty for non-compliance
Operating without the required registration or allowing an unlicensed contractor to supply labour can lead to fines and, for continuing violations, imprisonment of the Principal Employer or contractor under the Act.
