Copyright Registration in India: Process, Rights & Timeline
Copyright protects original literary, artistic, musical, and software works. Protection is automatic on creation, but registration provides prima facie legal evidence of ownership — invaluable when you need to enforce your rights or license the work.
What Can Be Copyrighted?
- Literary works — books, articles, and software source code.
- Artistic works — paintings, logos, photographs, and designs.
- Musical and sound recordings.
- Cinematograph films and audiovisual content.
The Registration Process
- Step 1: File Form XIV on the Copyright Office portal with work details and the applicable fee.
- Step 2: Upload a copy of the work and a statement of particulars.
- Step 3: A mandatory 30-day waiting period allows objections to be filed.
- Step 4: If no objection arises, the examiner reviews and the registration is granted.
Rights Granted
The owner gets exclusive rights to reproduce, distribute, adapt, translate, and publicly perform the work, plus the right to license it for royalties. In India, copyright generally lasts the author's lifetime plus 60 years.
Timeline
A smooth application registers in 4–8 months, largely due to the mandatory objection window. There is no renewal — protection runs for the full statutory term.
