Digital Signatures vs Electronic Signatures: Legal Validity in India

"Digital signature" and "electronic signature" are often used interchangeably, but they are legally distinct in India under the Information Technology Act.
Electronic Signature
A broad category — any electronic method of signing (a typed name, a scanned signature, an Aadhaar eSign). Validity depends on meeting the IT Act's reliability conditions.
Digital Signature (DSC)
A specific, cryptographically secure type issued by a licensed Certifying Authority on a secure token. It provides the strongest legal proof of identity and integrity.
When You Need a DSC
- MCA, GST, and income-tax filings for companies/LLPs.
- E-tenders and government procurement.
- DGFT and customs filings.
When eSign Suffices
Many everyday agreements can use Aadhaar-based eSign or e-signature platforms — but statutory filings require a DSC.
