Software source code in India is protected as a "literary work" under the Copyright Act, 1957 — the same category as books and written content. Copyright exists automatically the moment original code is written, but formal registration with the Copyright Office provides strong, dated legal evidence of ownership, which is invaluable in infringement disputes or licensing negotiations.
What copyright protects (and what it doesn't)

How to register software copyright
- File Form XIV with the Copyright Office, specifying "computer software" as the work category
- Submit the first 10 and last 10 pages of source code (with trade secret portions blacked out if needed, under specific provisions)
- Pay the government fee (varies by applicant type — individual/startup vs company)
- Respond to any objections raised during examination
- Registration certificate issued, typically within several months absent objections
Copyright vs patent for software
Copyright protects the code itself (automatic, cheap, broad literary-work protection); a patent could protect a novel technical process implemented by software (harder to get in India, as "computer programs per se" are excluded, but patents covering a technical effect are possible). Most software businesses rely primarily on copyright plus trade secret protection for proprietary algorithms.
Protecting code in practice
Beyond registration, use NDAs and IP-assignment clauses with every developer, contractor and employee, maintain version-controlled proof of authorship and dates, and consider registering copyright for major releases or core modules.
How long does software copyright last?
For a company/corporate author, copyright lasts 60 years from the year of publication — among the longest IP protection terms available for a technology asset.
