Advance Ruling Under GST (AAR): How to Get Tax Certainty Before You Act
An Advance Ruling under GST, obtained from the state's Authority for Advance Ruling (AAR), gives a business binding certainty on how GST law applies to a specific proposed (or ongoing) transaction — classification of goods/services, applicable tax rate, ITC eligibility, or registration requirement — before committing to it. It's a way to avoid costly disputes after the fact.
What questions can be referred to the AAR
- Classification of goods or services under GST (which HSN/SAC, and hence which rate)
- Applicability of a notification affecting the rate of tax
- Determination of time and value of a supply
- Admissibility of input tax credit on a specific purchase/expense
- Whether a particular activity amounts to a "supply" under GST at all
- Whether GST registration is required for a specific business activity
How to apply
- File Form GST ARA-01 with the jurisdictional state AAR, along with a statement of facts, the specific question, and your interpretation
- Pay the prescribed fee (a modest flat fee, separately for CGST and SGST)
- Attend a hearing if called, to present and clarify your case
- Receive the ruling — typically expected within 90 days of application, though actual timelines vary
Is the ruling binding, and on whom?
An AAR ruling is binding only on the applicant and the jurisdictional tax officer, for the specific transaction described — it does not set a precedent for other taxpayers, though rulings are often used as persuasive reference by others in similar situations.
What if you disagree with the ruling?
You can appeal to the Appellate Authority for Advance Ruling (AAAR) within 30 days of receiving the order.
When is it worth applying?
For high-value, recurring, or genuinely ambiguous transactions — a new product launch with unclear classification, a complex cross-charge arrangement, or ITC on an unusual expense category — the cost of an advance ruling is small compared to the risk of a demand notice years later with interest and penalty.
