A trademark registration in India is valid for 10 years from the filing date and must be renewed indefinitely every 10 years using Form TM-R, with a government fee of ₹9,000 (online) or ₹10,000 (physical filing) per class. Missing the deadline doesn't immediately kill the mark — a 6-month grace period applies, with a surcharge.

Why renewing on time matters more than it seems

A lapsed, unrenewed mark loses its priority date entirely — a competitor can file for and register the identical mark once it's removed from the register, even if you've used it continuously for years. Restoration after full lapse is possible but far more expensive and uncertain than a timely renewal.

Can a trademark be renewed forever?

Yes — unlike a patent (20-year hard limit), a trademark can be renewed indefinitely every 10 years as long as it remains in use, making it potentially the longest-lasting form of IP protection available.

What if the mark hasn't been used for 5+ years?

A registered-but-unused mark is vulnerable to a "rectification" application by a third party seeking to remove it for non-use, separate from the renewal process — active use strengthens your position regardless of renewal status.
