A trademark search checks the IP India public search portal for existing registered or pending marks that are identical or similar to yours, in your relevant class, before you file. Skipping this step is the single biggest cause of rejected applications and wasted government fees — a conflict found after filing can't be refunded.
How to run a basic search yourself
- Go to the IP India Trademark Public Search portal
- Search by word mark (exact brand name) and also phonetically similar spellings
- Check the correct NICE class(es) for your goods/services
- Review both "registered" and "pending/objected" status marks — pending applications can also block yours
- Check for similar logos if you're filing a device/combination mark, not just a word mark
What to look for in search results
- Identical marks in the same or closely related class — high risk of rejection
- Phonetically or visually similar marks — moderate risk, depends on goods/services overlap
- Same name in an unrelated class — usually low risk, as trademark protection is class-specific
- Status of conflicting marks — abandoned or opposed marks carry less risk than live registrations
Why a DIY search isn't always enough
