Customs Bonded Warehouse Scheme: Deferring Duty on Imported Goods

Customs Bonded Warehouse Scheme: Deferring Duty on Imported Goods

A customs bonded warehouse lets importers store imported goods under customs control without paying duty upfront — duty is only paid when goods are actually cleared from the warehouse for domestic sale (ex-bond clearance), or avoided entirely if the goods are re-exported. This defers a significant cash-flow cost for importers with uncertain or staggered demand.

How it works

  1. Obtain a private or public bonded warehouse license from customs (Form under Section 58 of the Customs Act)
  2. File an "into-bond" Bill of Entry for imported goods, which are moved into the bonded warehouse without duty payment
  3. Goods can be stored, and in some cases manufactured/processed, within the warehouse under bond
  4. When goods are cleared for domestic sale, file an "ex-bond" Bill of Entry and pay applicable duty at that time
  5. If goods are re-exported instead, no import duty is payable at all

Who benefits from bonded warehousing

  • Importers with large shipments but uncertain or seasonal domestic demand, who want to avoid paying duty on unsold inventory
  • Businesses re-exporting a portion of imported goods to third countries
  • Companies setting up a Manufacturing and Other Operations in Warehouse (MOOWR) facility, which allows duty-free import of inputs for manufacturing, with duty payable only on the finished goods cleared domestically

MOOWR scheme — manufacturing under bond

Under the MOOWR scheme, a business can import capital goods and raw materials duty-free into a licensed bonded manufacturing facility, manufacture finished goods, and pay duty only on the portion sold domestically — exports from the facility remain duty-free, making it attractive for export-oriented manufacturing.

Compliance obligations

Bonded warehouse operators must maintain detailed digital records of all goods received, processed and cleared, submit periodic returns to customs, and are subject to customs supervision and audit of the facility.

Cash-flow advantage in practice

For a business importing ₹1 crore of goods with a 20% effective duty rate, deferring that ₹20 lakh duty payment until actual sale — rather than paying it at the port — meaningfully improves working capital, especially for slow-moving inventory.

Considering bonded warehousing for your import operations? Our trade compliance team can assess whether it fits your business model.
